Please read these terms & conditions of sale carefully, as continued use of this website & any orders placed will be subject to these terms of business.
We may update this version of our terms of sale from time to time, without notice. Any reference within these terms & conditions made to “we”, “our” & “us” refers to www.muddyturnip.co.uk.
English is the only language in which we provide these terms of sale.
Privacy Policy
The sole purpose of this website is to enable customers to purchase products from Muddy Turnip online. We want you to be able to shop with confidence on our site, & therefore take the privacy of your personal information extremely seriously. Any personal information we collect from the website will be used in accordance with the General Data Protection Regulation which came into force in May 2018.
We only collect customer data (name, postal address, email & telephone number) that is essential for order processing and/or email newsletter contact. We are completely committed to protecting customer privacy & we will never pass, sell or rent any of your information to third parties.
Should you provide personal information over the phone, any temporary notes on paper will be processed & then shredded.
We do not collect or store your payment card information.
By providing personal information, you agree that we may use this information for the operation of the website, & the provision of services & products to you.
It is important that the personal data we hold about you is accurate & current. Please keep us informed of any changes in your personal information during your relationship with us.
Contracts of Sale
When you have finished placing an order with us via our website, you will receive email confirmation of this order. Only by receipt of this confirmation does a contract of sale exist between us. This term is included to protect us in the case that a mistake has been made in pricing, or we are no longer able to supply a particular item for some reason. In the former case, we will always contact you to make sure that the change in price is acceptable. In the latter case, you will be issued with a full refund.
If you do not appear to have received this confirmation email, please check your spam filter. If you are still unable to find the email please contact us to enquire about the status of your order.
If an item is delayed, due to re-stocking or other reasons, you will be informed of this delay by email, with the option to cancel your order if you do not wish to wait.
We will deliver the products ordered by you to the address which you provided when you placed your order. If any of the details in the address provided by you are incorrect, we are not liable for any items which have not been received – we will not verify personal information provided by you & we shall not be responsible for any errors or problems that arise as a consequence of inaccurate information submitted by you. Please check your order & delivery details before checkout & make any appropriate amendments.
Personalisation of Items – Content Rules
We reserve the right to refuse to print (or handwrite) & dispatch any written material or imagery that we deem to be inappropriate. We are a broad-minded bunch, but we will not be party to any content or material that we deem to be abusive, inflammatory, threatening or inciteful, that might cause distress or alarm to any person, including discrimination based on race, sexuality, disability, religion, age or nationality, or that may advocate, promote or assist any unlawful act. We reserve the right to cancel your order should we feel that your request gives the impression that the content has been approved by Muddy Turnip.
Payments
Payment must be received in full before orders will be dispatched. We accept payments in Pounds Stirling only. Our product prices do not include P&P. Delivery charges will be added at the checkout stage in the order process. Should payment not be received in a timely manner, & no later than 5 working days, we reserve the right to cancel your order.
Chargebacks
We do everything we can to try to make chargebacks less likely to happen: our business name is displayed clearly on customer receipts & bank statements to help with clarity in remembering making the purchase payment, we implement a fair & transparent returns policy to encourage the following of a normal returns procedure instead of the initiation of a chargeback, & we provide as detailed & accurate product descriptions as we can in order to try to avoid any confusion or dissatisfaction down the line.
A chargeback can be initiated by the customer or their bank for many different reasons:

The customer doesn’t recognise or remember the payment on their financial statement

Non-delivery of goods

The customer was expecting a refund that hasn’t come through to their account

An error with the sale e.g. charged the wrong amount

Using a card that has expired

Lack of funds in the customer’s account

Incorrect card details have been processed

The customer’s account is closed

The transaction was not authorised by the customer’s bank
PLEASE CONTACT US BEFORE INITIATING A CHARGEBACK & we will endeavour to remedy the issue. We will respond to requests for information or ‘retrievals’ as quickly as possible.
If you dispute any payment made to us, you must contact us immediately & provide full details of your claim.
If you submit an unjustified credit or debit card or other chargeback then you will be liable to pay us, within 7 days of the date of the chargeback, an amount equal to the chargeback plus any additional fees incurred by the chargeback service (there will nearly always be an additional fee from the acquirer for each chargeback claim).
For purposes of clarification, if you fail to recognise or fail to remember the cause of an entry on your card or other financial statement, & make a chargeback as a result, this will constitute an unjustified chargeback.
Cancellations
You have the right to cancel a distance contract to purchase a product or products from us within 7 working days after you have received the relevant product/s (subject to the below limitations):
You will not have any such right insofar as a contract relates to:

The supply of goods made to your specification/s

The supply of personalised goods
In order to cancel an order in this way, you must give us written notice of cancellation, & promptly return the product/s to us, in the same condition in which it/they were received by you. In this case we will issue a full refund for the goods, but we will not refund the delivery charge, & you (the customer) will be responsible for the cost of returning the goods to us. Such returns must be sent by recorded delivery to avoid any further dispute arising from non-receipt of the return/s.
If you cancel a contract with us on this basis & you do not return the goods, you will not be issued with a refund, & we may recover the products & charge you for the costs incurred in doing so. Similarly, if you return the goods at our expense (e.g. post the returns without correct postage being applied), we will pass that expense on to you by deducting it from your refund total.
Newsletters
From time to time we may contact previous customers via email to inform them about our products, discounts & special offers. You can opt-out of inclusion in this at any time if you no longer wish to receive information notices, & we will always act upon your instruction.

Law & Jurisdiction
Muddy Turnip & all parties involved in creating & maintaining the website hereby exclude all liability & responsibility for any amount or kind of damage or loss incurred by:

Issue or offence caused by mistakes made in your message, where you have asked us to send an item directly to a third-party recipient. We will copy your message exactly as entered by you during the order process & will not attempt to verify & check any mistakes in the message or address that you may have made.

Failure of the delivery company or Royal Mail to deliver your return/s to us, or any damage suffered during this delivery process.

In no event shall our total aggregate liability to you for all & any damages and/or losses exceed the amount paid by you for your total order.
The terms above, including contracts of sale, are subject to the laws of England & Wales. Any dispute arising in connection with our business, which is not resolved by normal complaints procedure, shall be subject to the exclusive jurisdiction of the courts of England & Wales. Those accessing the site from other locations are responsible for compliance with their own local laws & taxes as applicable.
